VW Emissions Settlement Program in Canada

The Registrar of Motor Vehicles (the “Registrar”) has implemented a onetime program for the release of personal motor vehicle information for the VW Emissions Settlement Program in Canada.

VW may ask you to present specific documents supporting your claim. The Registrar releases Motor Vehicle Information Products (MVIPs) that may satisfy the requirements of the VW Canada Settlement program.

VW claimants may submit a claim until September 1, 2018. The process implemented by the Registrar will be terminated on December 31, 2018.

What’s important to know

You must apply under the VW Emissions Settlement Program in Canada to obtain a reference number before you can request information from the Registrar. In addition, using the VIN of the vehicle, you have to order a Vehicle Information Report (VIR) from any Alberta Registry Agent (RA). You have to pay the applicable government search fees and registry service charges.

Who may request information

This process can be used to request information by:

  • a current or previous Registered Owner (RO) of the vehicle; or
  • the authorized person representing the estate of a current/previous RO of the vehicle

Types of MVIPs released

Depending on specific needs of the client the Registrar may release the following MVIPs for the VW Emissions Settlement Program in Canada:

  • VIN-based Vehicle Registration (VR-V) Search Report (SR);
  • VIN-based Vehicle Registration (VR-V) Confirmation Letter (CL);
  • VIN-based Vehicle Registration (VR-V) Not Found Report (NFR).

The VR-V SR confirms the registration of a vehicle identified by the VIN. You can order a VR-V SR for a vehicle that is registered in your name only. To order a VR-V SR for a vehicle if you are one of the members of a joint registration you must provide the written consent of the other members.

VW may ask you to present documents confirming historical registration information. Also, VW may ask you to present copies of the ownership documents used at the time of registration.

To address this need the Registrar releases a onetime VIN-based Vehicle Registration (VR-V) Confirmation Letter (CL) that:

  • Confirms the periods of registration of a VW vehicle under your name;
  • Confirms the number of members for a joint registration (if applicable);
  • Embeds copies of the ownership document(s) (if archived) presented to the Registrar to register this vehicle under your name, on a specific date.

To request information you must complete a Request/Agreement form. By completing, signing, and dating this form you enter into a onetime agreement with the Registrar.

A VIN-based Vehicle Registration (VR-V) Not Found Report (NFR) is released to you when:

  • the relevant RO cannot be uniquely identified on Registrar’s system (MOVES);
  • there are errors or conflicts in the information you provided in the Request/Agreement form, the supporting documents, and the information on MOVES;
  • your request has been denied.

Requesting Information

To request information you must:

  • Apply under the VW Emissions Settlement Program in Canada to obtain a unique reference number;
  • Order a Vehicle Information Report (VIR) for the relevant vehicle;
  • Using the VIR establish the date the vehicle was first registered under your name;
  • Using the VIR establish the relevant registration date for which you intend to request the supporting ownership document presented to register the vehicle in your name.

Special situations:

  • When a registration refers to a joint registration, each RO can order a separate VR-V CL that confirms the periods of registration of the vehicle in their name and provides the number of members for each joint registration;
  • When you can be present in the office of a RA you must complete and sign the form A-004 in front of the authorized RA staff;
  • When you are out of province and cannot be present in the office of a RA you must use the notarized form A-005;
  • When you represent a RO that is an organization you have to be an employee of that organization and must present a valid document authorizing you to request information in the name of your employer;
  • When you have changed your name you have to present appropriate documents to prove the name change;
  • When you represent the estate of a current/previous RO you must present a copy of the relevant documents that authorize you to apply in the name of the estate of the RO.

Completing and processing the form A-004:

To request information in the office of a RA you must:

  • Provide acceptable photo identification;
  • Provide a valid copy of a VIR for the relevant vehicle;
  • Provide the original document(s) required for the special situation that may apply;
  • Provide a completed form A-004;
  • Date and sign the completed form A-004 in front of the authorized RA staff;
  • Pay the applicable government search fee and registry agent service charge.

The form A-004 provides detailed instructions guiding you on how to apply, complete the form, and prepare the required Request Package.

Completing and processing the form A-005;

To request information when you are out of Alberta and cannot be present in the office of a RA you must use the notarized request process. You must:

  • Be present in the office of a Notary Public;
  • Present to the Notary Public acceptable photo identification;
  • Present to the Notary Public original copies for the documents required for each special situation that may apply;
  • Provide a completed form A-005;
  • Date and sign the completed form A-005 in front of the Notary Public. The Notary Public must then notarize the signed form A-005 and copies of the documents required for each specific situation;
  • Provide a valid copy of a VIR for the relevant vehicle;
  • Contact the RA to forward the Request Package to the RA and to arrange for the delivery of the relevant MVIP;
  • Pay the applicable government search fee, the RA service charge, and the relevant delivery costs.

The form A-005 provides detailed instructions guiding the clients on how to apply, complete the form, and prepare the required Request Package.

Release of information

Information is released only for purposes related to the VW Emissions Settlement Program in Canada.
